Initial Query & Free Trademark Search

You contact us with your proposed brand name, logo or slogan. We perform a free trademark search to check if something similar or identical exists. This helps avoid rejections down the line.

Document Preparation & Application Drafting

Once the trademark is found to be available (or sufficiently unique), we’ll ask you for the required documents: ID proof, address proof, logo/design files, etc. We will draft your trademark application correctly, defining the classes (goods/services) under which you want protection.

Authority Letter (Power of Attorney)

You’ll need to provide a signed authorization form or power of attorney, allowing Govendor (or its legal representative) to file on your behalf.

Filing the Application with the Trademark Registry

We submit the trademark application to the appropriate Trademark Registry office / authority. You receive an application number, which you can track during the process.

Examination & Objections

The registry will review your application. If there are any objections — either from an examiners or third parties — we’ll assist with drafting responses or adjustments. Sometimes a hearing may be needed; we prepare you for that.

Publication in Trademark Journal

After the registry approves the application (pending no major objections), the mark is published in the official Trademark Journal. Others have a chance to oppose during a fixed period.

Registration & Certificate Issuance

If there are no oppositions, or if oppositions are resolved in your favor, the registry issues the registration certificate. Congratulations — your mark is now in your name, secured for the classes you applied for.

Renewal & Monitoring

Trademark registration in India (and many other places) is valid for 10 years from date of the certificate. After that, you can renew indefinitely by paying renewal fees. We also offer monitoring — checking if others are trying to register similar marks, and alerting you to infringements, so your rights stay protected.

Q2. How long is a trademark valid in India?

A registered trademark is valid for 10 years from the date of registration. It can be renewed indefinitely every 10 years by paying the renewal fee.

Q3. Can I apply for a trademark before starting my business?

Yes. You can file a trademark application even if your business hasn’t started yet, by filing it under “proposed to be used.”

Q4. How much time does it take to get a trademark registered?

The process usually takes 12–18 months, depending on objections, oppositions, and workload at the Trademark Registry. However, you can start using the ™ symbol as soon as your application is filed.

Q5. What’s the difference between ™ and ® symbols?

• ™ means your trademark application has been filed but is not yet registered.
• ® can only be used once your trademark is officially registered.

Q6. What happens if someone objects to my trademark?

If the Trademark Registry or a third party raises an objection, you will have to file a written response. Sometimes a hearing is also scheduled. Govendor assists you at every stage until the matter is resolved.

Yes, if you want protection for both. You can apply for your brand name in text form (word mark) and your logo in graphic form (device mark).
